These terms cover the use of Deskwork, a back-office application for real estate brokerages. They are written to be read once and understood, not to be long. "We", "us" and "our" mean Deskwork (deskworkapp.com), which operates the service. "You" means the brokerage that has a desk on the service, and the people it gives access to.

Using Deskwork means these terms apply. If your brokerage has signed a separate written agreement with us, that agreement wins wherever the two disagree.

1. Who may use it

  • Deskwork is for licensed real estate brokerages and the agents and staff they employ or contract with.
  • Access requires a Google account — or, where your office offers it, a Microsoft account — and an address that appears on your office's roster: a work account on a domain your brokerage has approved; or a work account on your own business's domain, or a personal Gmail or Outlook.com account, whose exact address your brokerage has put on its roster.
  • Your brokerage is responsible for keeping that roster current, including removing people who have left. Removing somebody from the roster or marking them departed ends their access at once; disabling their Workspace or Microsoft 365 account on your brokerage's own domain ends it within an hour, including a session they already have open. For a personal Google or Microsoft account, or a work account on their own business's domain, the roster is the only control.
  • Accounts are for one person. Do not share sign-in access with anyone.
  • You must be at least 18 years old to use the service.

Setting up a desk yourself. A brokerage can set up its own desk from our signup page, signed in with the Google Workspace account its email runs on or with a Gmail address — or, where the signup page offers Microsoft, with the brokerage's Microsoft 365 account or an Outlook.com address. Whoever signs up becomes the desk's owner, and by signing up says they are allowed to set it up for the brokerage they name. For a Workspace or Microsoft 365 account, Google or Microsoft tells us the account is on the brokerage's domain; it does not tell us who speaks for the brokerage, so we allow one desk per domain unless we have agreed otherwise. If a desk already exists for your domain, ask its owner to add you. A desk set up with a Gmail or Outlook.com address lets in only the people its owner adds to its roster, and we allow one per address; we may look at a desk set up with one before it opens.

2. Your records are yours

Everything your office puts into Deskwork — your roster, your commission plans, your transactions, your dates, your checklists, your statements and your figures — belongs to your brokerage. We do not claim ownership of it.

We use it only to run the service for you: to store it, display it back to the people you have authorized, calculate what you asked the product to calculate, and send the nine kinds of message described in the privacy policy (a commission statement, a deadline digest and a send-back note; if your office turns them on, a file update alert, a closing reminder, a document reminder and a weekly summary; a sign-in invite to each person your office chooses to invite; and a deletion notice to the broker-owner if the desk is set to be deleted). Statements held by the daily email limit or an automatic pause wait on your desk and are sent when Live email can send them. Eligible exact roster addresses include agents using their own Workspace domain on an office admitting work domains. The Email card shows messages waiting and any storage problem. We do not sell it, we do not share it with advertisers, and we do not use it to train machine-learning models.

You are responsible for the accuracy of what you enter and for having the right to enter it, including information about your clients and the other parties on a transaction.

3. What the service does not promise

Three things are worth being blunt about.

  • It is not professional advice. Deskwork calculates commissions, caps, fees and annual totals from the figures and plans your office enters. It is not legal, tax, accounting, compliance or brokerage-licensing advice. What you report to a tax authority, what you pay an agent, and what you file with your regulator remain yours to check and yours to sign. Check the numbers against your own records before you act on them.
  • It is not your document archive. Deskwork records the name of a document and whether it has been filed. It does not store the document itself: a document added in Deskwork is passed straight to your own Google Drive, and your files stay there. A picture chosen as the file's photo is kept with the file; the document in Drive stays as it is. Keeping and backing up those documents is your brokerage's job, and a record marked complete here is not a copy of the paperwork.
  • It is not a system of record for your legal obligations. Retention periods, transaction-file requirements and the rest of what your state and your board require of a broker are your responsibility. Deskwork helps you see them; it does not discharge them.

4. Availability and changes

We work to keep the service up and to keep your records safe, but we do not promise uninterrupted availability. The service may be unavailable for maintenance, for a fault, or for something outside our control.

The product is actively developed. Features may be added, changed or removed. If something is being removed that your office relies on, we will tell you before it happens rather than after.

5. What you agree not to do

  • Try to reach another brokerage's records, or any account or data that is not yours.
  • Probe, scan or test the security of the service, or work around any access control, role restriction or sign-in requirement.
  • Use the service to break the law, to breach real estate licensing or fair-housing rules, or to hold information you have no right to hold.
  • Copy, resell, sublicense or rebrand the service, or make a derivative of it.
  • Interfere with the service for others, including by automated traffic that degrades it.
  • Set up a desk under a name, or for a brokerage, that is not yours — including a name chosen to look like another business, to hold it from its owner, or to mislead the people put on its roster.

If something is broken or exposed in a way it should not be, tell us at support@deskworkapp.com rather than exploring it. We will treat a report in good faith as a report, not as a breach of this section.

6. Fees

What your brokerage pays, and when, is set out in the separate written agreement or order between us. Nothing on this website is an offer of a price, and no fee is charged to an agent personally.

A desk set up through the signup page is on the free plan: nothing is charged for it, and no payment details are asked for. If paid plans are introduced later, we will tell the desk's owner first, and nothing will be charged without their agreement.

7. Our software stays ours

Deskwork, its source code, its design and its name belong to us. Using the service does not transfer any of that to you. Your records staying yours (section 2) and our software staying ours are two separate things, and both hold.

8. Ending it

Your brokerage can stop using Deskwork at any time. We can end access if these terms are seriously or repeatedly broken, or if fees agreed in writing go unpaid, and we will tell you why and give you a chance to put it right where the circumstances allow.

We look at every desk set up through the signup page. Until we have, its email goes only to its owner. If a desk was set up in a name that is not the signer's, imitates another business, or is used to mislead, we may hold it, remove it, and let the business the name belongs to have it. Before removing a desk we keep an archive of its records, and we tell its owner why at the address it was set up with. If you think somebody has set up a desk in your brokerage's name, write to support@deskworkapp.com.

Your broker-owner can download a copy of your brokerage's records at any time, from Office settings in your desk. When access ends, you may also ask us for a copy and ask us to delete your records from our servers. We will do both. Write to privacy@deskworkapp.com and say which you want. The broker-owner can also delete your desk from Office settings: it keeps working for 14 days, during which they can cancel, and then it closes. We keep its records, encrypted, for 30 days after that, in case it was a mistake, and then delete them from our servers, as the privacy policy describes.

9. Warranties and liability

The service is provided as it is. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, neither side is liable to the other for indirect, incidental, special or consequential loss, or for lost profits, lost business or lost data, arising out of the use of the service. Our total liability for any claim relating to the service is limited to the fees your brokerage paid us for it in the twelve months before the claim arose.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

10. Indemnity

You will cover us against claims brought by a third party that arise from your brokerage's use of the service in breach of these terms or of the law, including a claim about information your office entered that it had no right to enter.

11. Governing law

These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules. The courts of the State of Michigan have jurisdiction over any dispute, and both sides agree to try to resolve it directly first.

12. Changes to these terms

If we change these terms, we will update this page and the "last updated" date at the top, and tell the brokerages using the product about any material change before it takes effect. Continuing to use the service after that means the new terms apply.

13. Contact

Deskwork (deskworkapp.com) operates the service. Questions about these terms: support@deskworkapp.com. Questions about information and privacy: privacy@deskworkapp.com, and the privacy policy is the fuller answer.
